miss A's Suzy Loses Lawsuit Against Online Shopping Site

South Korean girl group miss A member Suzy lost the case she has filed against an online shopping site which used her name and face for its promotions without her permission.

On February 15, Sunday, the Seoul Central District Court has decided against the singer's lawsuit which she filed late last year against an online shopping website which used her name and posted her photos from past interviews and paparazzi shots of her airport fashion in order to promote their product called 'Suzy hats'.

The defendant, which has been referred to in past reports as 'shopping mall A', is said to have sold the hats for almost three years, starting from September of 2011 until February of last year.

Upon discovery, Suzy filed a lawsuit against said online shopping mall, claiming publicity rights. The singer demanded rights to control the commercial use of her name, image and other matters which involve her person.

However, the Seoul Court ruled against her claims. The court admitted that her rights to control the use of her name for commercial purposes is included in her rights to her name and image, but the jury also decided that there is no such thing as a separate publicity right to be acknowledged.

Furthermore, the court decided that the evidence presented in court is not sufficient to prove that there had been damage done to her. The court says, " There isn't enough evidence to prove that, as a result of the infringement of Suzy's rights to her image and name, she was unable to sign new contracts or had to terminate existing ones."

The court has then decided to dismiss her claims for damages also because there wasn't sufficient proof that she suffered from financial losses as a result of the infringement.

Following the court's decision, JYP Entertainment, Suzy's entertainment outfit, expressed their disappointment over the matter and stated that they are yet to decide whether they will appeal to the court after a consult with their legal representatives.
