Qualcomm Sues Meizu Over Unauthorized Use of 4G and 3G Patents

Chinese tech giant Meizu is facing a legal suit launched by mobile chip manufacturer Qualcomm regarding the unauthorized use of the latter's technology related to 4G LTE and 3G communication standards.

Qualcomm recently announced that the company has already filed the complaint at the Beijing Intellectual Property Court. Qualcomm added that it was forced to raise the issue in the higher court after Meizu refused to negotiate "in good faith" to get a license for the 4G and 3G patents.

Qualcomm is asking the intellectual property court to confirm that the company's terms for patent license agreement are in accordance with China's anti-monopoly laws. Qualcomm also said that it is adhering to the 2015 remediation agreement with the National Development and Reform Commission (NDRC).

It is important to note that Qualcomm's settlement with the NDRC involves the payment of a $860 million fine and changing its business practices in China. The settlement agreement also requires Qualcomm to provide local Chinese companies with an affordable means to access the company's Android patents. Following the settlement agreement, Qualcomm has since signed up more than 100 Chinese firms to licensing agreements.

In a press statement, Qualcomm executive vice president and general counsel Dan Rosenberg said, "Qualcomm's technologies are at the heart of all mobile devices. Meizu is choosing to use these technologies without a license, which is not only unlawful but unfair to other licensees that act in good faith and are respectful of patent rights, and ultimately damaging to the mobile ecosystem and consumers."

Rosenberg also highlighted the good business track record of Qualcomm and its growing market in China. He said that Qualcomm is "pleased" with the growth and success of Chinese smartphone manufacturers, which are getting a lot of positive attention both domestically and in the international market.
