Huawei Files Lawsuit T-Mobile for Patent Infringement

Huawei has filed a lawsuit against T-Mobile for mobile patent infringement.

Chinese telecommunications giant Huawei claims that the American wireless carrier has been using its 4G patented technology without proper patent licensing. The lawsuit said that carrier rejected a deal to license 14 Huawei patents but continued to violate its 4G Wireless Network Essential Patents.

The Chinese company says it is ready to offer a license with terms and conditions under fair, reasonable, and non-discriminatory or “FRAND," Digital Trends reported. T-Mobile has not taken the offer and continues to use the patented technologies.

These patents include 8,537,779 (processing handsets joining a network) and 8,031,677 (handing over a moving device from one network to another).

“Huawei brings this action because T-Mobile has refused Huawei’s FRAND offer, but continues to practice, use, or otherwise comply with 4G standards covered by Huawei’s 4G Wireless Network Essential Patents by operation of its cellular telecommunications network,” court documents said.

Huawei is not after financial damages, but it is requesting that the court declares that the Chinese tech giant has met its obligations to license patents at a fair and reasonable rate and orders T-Mobile to recognize the license, according to ZDNet.

The conflict between the two companies started in 2014. Huawei wanted to begin a licensing discussion, but T-Mobile allegedly would not sign a non-disclosure agreement and negotiations stalled. In addition, T-Mobile sued Huawei in 2014, accusing the Chinese company of stealing the designs and parts of its top-secret cell phone testing robot, nicknamed “Tappy."

In February, Huawei also filed several patent infringement complaints against T-Mobile. The court documents stated that Huawei and T‑Mobile repeatedly engaged in unproductive negotiations, and could not even agree on a non-disclosure agreement to prevent either side from going public with the details of their agreement.
