NASCAR: Tony Stewart On-Track Death Case Goes to Grand Jury

Three-time NASCAR champion driver Tony Stewart's deadly run-in with fellow driver Kevin Ward Jr. is going to a grand jury for possible charges, Ontario County (N.Y.) District Attorney Michael Tantillo said Tuesday.

In a written statement, Tantillo said law enforcement officials and prosecutors had reviewed the investigation and forwarded results to the grand jury. He said it was appropriate for the grand jury to determine what actions should be taken in the case.

No more information would be released at this time, the D.A. said citing confidentiality of grand jury deliberations. The grand jury will hear the case "in the near future," he said, adding he couldn't say who would testify or what testimony would be presented.

Stewart issued a statement saying he respected the process and looked forward to it being completed. He would cooperate fully with the grand jury, Stewart said.

NASCAR information officer Brett Jewkes said the group was aware of the grand jury process and would monitor the situation. Otherwise, it was inappropriate for NASCAR to comment, he said.

With the Ontario County Sheriff's Office investigation now concluded, Sheriff Phillip Povero said investigators had examined a forensic video enhancement of the incident along with other material and statements.

Stewart, 43, was involved in the on-track incident with Ward, 20, an up-and-coming young driver, resulting in Ward's car spinning out of the race and into an embankment. Ward then angrily left his vehicle and tried to confront Stewart on the track as cars whizzed by under a yellow caution flag.

During that time, numerous cars passed by Ward. However, Stewart's car veered and struck Ward, killing the young driver. No arrests were made and Stewart dropped out of a subsequent race.
