Chinese iPhone User Sues Apple for Invasion of Privacy

A Chinese iPhone user has filed a lawsuit in California against Apple, Inc. alleging invasion of privacy.

A report about security concerns on the iPhone's location-tracking functions by a Chinese state broadcaster started the lawsuit.

A woman named Chen Ma filed the U.S. class action lawsuit and said that Apple “intentionally intruded” into her privacy via iPhone’s location tracking service. According to her, Apple also disclosed the information to third parties like the U.S. government.

The lawsuit mentioned a July 11 report from China Central Television (CCTV), a state-owned media company, which warned iPhone users that location-tracking functions of Apple could be a security threat.

Apple's “Frequent Locations” feature is the primary function in question. Frequent Locations records the places users have visited.

It also indicates the user's duration of stay and provides some suggestions about nearby shops and restaurants plus estimated times of walking and driving.

CCTV said the feature could be an effective tool for spying on users. A security researcher interviewed by the station said the data could also reveal information about China's economy and other state secrets.

After CCTV's report, Apple released a statement reassuring iPhone users they're not tracking their locations at all. The company also said they neither access the Frequent Locations function nor work with any government agency to insert backdoors in its phones.

Apple did not comment on the class action lawsuit.

Chen Ma filed the case against Apple in the U.S. District Court for the Northern District of California, San Jose division.
