Grand Jury to Hear Michael Brown Shooting Case on Wednesday

State Of Emergency, Curfew Declared in Ferguson

Missouri Governor Jay Nixon declared a state of calamity and imposed a curfew in Ferguson

Prosecutors intend to present evidence in the case of the Ferguson, Missouri police shooting, which led to an unarmed teen's death, to a grand jury on Wednesday, in response to the call for justice from the victim's supporters.

In spite of the discreet nature of the grand jury where defendants often do not show, Ferguson police officer Darren Wilson, who was recently identified as the shooter who killed 18-year-old teen Michael Brown, will still be given an opportunity to testify during the arraignment.

A spokesman for St. Louis County Prosecuting Attorney Robert McCulloch, Edward Magee, said that Wilson will be given a choice to defend himself for the teen's death, adding that McCulloch will not relieve himself from the case amidst demands that he do so due to his ties with Ferguson police.

A grand jury does not follow standard trial procedures and can decide even without a unanimous decision, that is, nine out of 12 members should agree on whether to charge Wilson or not.

Susan McGraugh, a supervisor of the Criminal Defense Clinic at St. Louis University Law School, explained that the grand jury may see evidence which indicates first-degree murder, but it is also possible they'll decide "it's less than that."

Meanwhile, unrest in Ferguson has reached an all-time high since the shooting incident on August 9, and local authorities are calling on residents to let the justice process "take its course."

In recent protests, authorities have turned to using tear gas as some protesters throw rocks at them.

Protests, especially during the evenings, have become more frequent over the past ten days. Tuesday evening was no exemption when a group of people marched down the West Florissant Avenue holding their hands up chanting "Hands up, don't shoot."

On Tuesday, however, a curious group of demonstrators comprised of elementary school girls handed out flowers instead.
