Virginia Lawyer Returns To Congress Despite Sex Scandal Conviction

House Democratic Minority Leader David Toscano said on Wednesday that the U.S. Congress is considering all its options to boot out returning Virginia representative Joseph Morrissey who has been convicted for sex offences involving minors.

However, Morrissey insists on returning to his old job even if no one wants to touch him with a 10-foot pole.

No one was talking to him on the first day of the 2015 legislative session and he has been booted out from committees, moved out of his old office. Morrissey now has a desk on the House floor in a far corner, like a misbehaving kid made to stand on a corner.

The 57-year-old Morrissey certainly has his share of bad behavior that deserved more than a rap on the hand. In December, he was convicted of contributing to the delinquency of a 17-year-old girl who was the receptionist at his law firm and whom he got pregnant.

Another evidence that prosecutors had that convinced the court that he was having sex with a minor then were nude photos of his sex partner on his mobile phone. He allegedly shared the lewd photos to a friend.

He is also a playboy, having fathered three children with different women out of wedlock, while remaining a bachelor. To avoid felony charges that carry with it years of jail term and being kicked out of the Lower House, Morrissey entered a misdemeanor plea which nevertheless landed him in jail.

After the conviction, he quit his Henrico district seat in December and ran again as an independent candidate since the Democrats had removed him from its nomination process.

Other black marks on the legislator includes recorded fistfights, citations for contempt of court and disbarment as a lawyer.

He discovered on Tuesday that he won the election with 42 percent against his Republican and Democratic rivals. But there was actually a very low voter turnout, and only 2,840 people brought him back to Congress.


On Wednesday, because his car would not start, he left it behind at the Henrico County jail parking and hitched a ride with a Washington Post reporter who interviewed him along the way to the capitol.

While he was sentenced to 12 months in jail, six months of which were suspended, he got a work-release arrangement that permitted him to practice law and campaign by day and now go to Congress, while serving time at night, provided he wear an ankle monitor.

As House leaders decide on a move that aims to oust Morrissey from his seat, it would be a historical event if it succeeds in expelling Morrissey since no one had been kicked out on ethical grounds since 1876. Such an event happens if two-thirds of 100-member House would agree on a motion.
